When in Doubt, Add an Expert: The Changing Nature of Evidence Presented in Climate Change Litigation in the Land Court of Queensland

Abstract

Climate change and the effect of greenhouse gases has been a central to Land Court decisions on whether or not to recommend a new coal mine since 2007. The evidence about greenhouse gases emissions has become increasingly sophisticated. The evidence about climate change has devolved into evidence from a plethora of different ‘environmental’ experts. The presentation will look at the changes in the people who give evidence, the nature of the evidence and its effectiveness in litigation.
